Today the Daily Mail demands action against the menace of cowboy wheel clampers.

The industry rakes in almost £1billion a year from motorists parked on private land and has been described as ‘legalised mugging’.

Clampers routinely charge £500 penalties, tow away cars, prey on the vulnerable and are often paid on commission, encouraging them to immobilise as many vehicles as possible. But despite the extraordinary power they wield, those working on private land in England and Wales are completely unregulated and their victims have no right of independent appeal.

The Mail, supported by motoring groups and MPs, is calling for an end to this unfairness by bringing the law for parking on private land in line with that for public roads, including the introduction of a maximum limit for penalties.

Experts say the major flaw in the current regime is that the company which issued the penalty in the first place is allowed to act as judge and jury in the case – unlike on public roads, where an appeal can be made to an independent tribunal.

The clampers can charge whatever they like and are even allowed to exploit the Government’s supposedly confidential DVLA database to find drivers’ names and addresses at £2.50 a time.

It has led to clamping becoming a boom industry. Between March 2008 and April 2009, the number of licensed clampers rocketed by a staggering 58 per cent – from 1,200 to 1,900.

Instead, when ministers publish their clamping Bill later this year, the Mail calls for the legislation to include:

• An independent tribunal to hear appeals by motorists who are clamped on private land.

• Maximum penalties for infringements on private land to be brought in line with those on private road.

• A ban on towing away a vehicle unless it is posing a danger, blocking access or has been abandoned.

• Prohibition of offering incentives to private clampers, based on how many motorists are issued with penalty charges.

Millions of motorists are being ‘legally mugged’ by cowboy clampers whose antics are ‘out of control’, a damning report by the AA reveals today.

Growing parking enforcement in private car parks and the huge amounts of money being taken from drivers has reached ‘epidemic’ level, says the AA. More than one in 10 drivers say they have been issued a private parking ticket over the last year* and tens of thousands of people have had their car clamped or removed from private car parks.

An ‘epidemic’ has seen nearly £1billion being taken from half a million drivers a year in private car parks by an army of 2,000 clampers.

Motorists routinely pay in excess of £500 to retrieve their clamped and towed away cars with no way to challenge the fines independently except expensive battles in a county court.

Private parking enforcement is riven with ‘bad and immoral’ wheelclamping practices that are ‘frightening and often bordering on criminality’, says the AA, with women motorists in particular feeling ‘menaced’ and intimidated.

The organisation adds that anyone may set himself up as a parking enforcer and ‘start to cash in’.

Alarmingly, clampers are allowed to exploit the Government’s supposedly confidential DVLA database to get drivers’ names and addresses at £2.50 a time.

The AA wants the Government to make it illegal in England and Wales to clamp on private land, as it is in Scotland where it has been considered ‘extortion and theft’ since a 1992 court ruling.

About one in 17 motorists have been clamped, says the RAC Foundation, which also believes the law to be ‘suspect’ and open to legal challenge.

The Government estimates there are between 100 and 200 clamping companies. Some 1,900 individuals have valid licences from the Security Industry Association (SIA). Since May 2005 only 16 have been revoked and 233 refused.

The AA’s Press Release points to some recent incidents, some of which are shocking nonetheless unacceptable to any motoring public (unless, you are not from a civilised part of the world, where anything and everything goes):

The prevalence of bad and immoral practices is now shocking and unacceptable. Whilst the AA accepts that some enforcement is justified, the scale of private enforcement and level of punishment meted out by an army of private enforcers is frightening and often borders on criminality.

In recent examples:

  • An elderly pensioner and her sick husband who were wrongly ‘doubled charged’ £370 by a clamper/tower (who belonged to the ‘trade association’ and breached its code despite having declared it would abide by its rules) – they have now recovered their cash after threats of legal action.
  • A lady who stopped, literally for seconds, heard a noise at the rear of her car. Someone said ‘I won’t be a moment’ and clamped her car while she sat in it with the engine running – before ‘double-charging’ her £300.
  • A lady who was given a ticket in a free car park for straddling lines. The ticket could not be paid as there were no details on it, and then she was sent a ‘£100 Charge Certificate’ after the parking firm obtained her details from DVLA despite inadequate signing in the car park
  • A lady, on her own, whose car was clamped and removed in Enfield at night and was charged £527 to get her car back – the clamper belonged to the ‘trade association’ and breached its code despite having declared it would abide by its rules.

Private enforcers can either wheel clamp and remove or issue ‘parking tickets’, usually by accessing the car owners name and addresses from the DVLA’s vehicle database.

A couple of months after the presidential election, and a couple of weeks after Barack Obama signed his stimulus bill, the giddiness among transport advocates was enough to induce a contact high: $8 billion for high-speed trains, and another $8.4 billion for mass transit! They were excited for good reason: For years, the country has starved for any attempt to develop green transit, and finally we had the money.

But what if most mass transit is doomed to fail? It isn’t the mere lack of trains and subways that keep people in their cars. It’s what urban planners call the first- and last-mile problem. You know it, intuitively. Let’s say you’d like to commute on public transit. But if you live in a suburb—and ever since 2000, over half of Americans do—it’s unlikely that you live close enough to a station to walk. The same problem arises once you get to your destination: You probably don’t work anywhere near the closest bus or train station. So even if public transit is available, commuters often stay in their cars because the alternative—the hassle of driving, then riding, then getting to your final destination—is inconvenient, if not totally impossible. “Denser areas don’t have these same problems,” says Susan Shaheen, who heads the Innovative Mobility Research group at the University of California, Berkeley. “The problem is really about land use in the United States.”

It sounds nearly impossible to fix: Our suburbs won’t soon disappear, even if some are withering in the present housing decline. But here’s the good news: For the first time in three decades, solving the last-mile problem seems just within reach, owing to vehicle fleets and ingenious ride-sharing schemes that lean on mobile computing, social networks, and smart urban planning. “To make public transit viable, you have it make it just as easy as getting in a car,” says Shaheen. “It can be done.”

The challenge, according to Dan Sturges, the founder of Intrago Mobility, which creates vehicle-sharing technology, is that “no one’s yet putting these innovations together as a system, and the public doesn’t understand the broader problem. But if implemented all together, the things being invented now will make owning a personal car into a joke.” The enemy is really the car’s unequaled convenience; commuters need multiple, equally easy choices before they’ll give up the steering wheel. Several such choices are in the works.

“Right-Size” Fleets

Zipcar—which is now being copied by Hertz and U-Haul—is a godsend for city dwellers who only occasionally need a car. But it can also be used to solve the last-mile problem, when linked with public transit. “We’re at the tip of the iceberg with those systems,” says Sturges. However, for many commutes, a car is overkill. What if the closest bus is just a mile and a half away? A “right-sized” vehicle, suited to your particular last-leg commuting need, is ideal. These might be anything from a Segway (dorky as it may be) to an electric bike or a high-powered electric golf cart. But the vehicles themselves aren’t the solution, since commutes can change every day (say you’re visiting a client one day, and eating lunch at your desk the next).

Park, Charge, Go Green! Solar Carport Gives Plug-Ins a Charge

One of the great criticisms of electric vehicles is the power they rely on often comes from fossil fuels, leading critics to question how “green” they are. A British firm has a solution for that — a carport topped with photovoltaic cells that can charge an EV.

Specialty glass and plastic manufacturer Romag says the PowerPark is just the thing for parking lots where electric vehicles may one day compete for spots to plug in. The first PowerPark was installed at the company’s headquarters, and Romag says additional installations are planned around the United Kingdom.

So far, the cost of installation and materials varies based on volume and location, but Webster said that the canopies could be purchased singly or in groups. Pricing “should be competitive with other forms of BIPV.” That’s Building Integrated Photovoltaics, for those of you who are really off the grid.

 

Each PowerPark canopy is rated at 1.5 kilowatt peak, a measure of a photovoltaic system’s peak output. Even in misty, foggy Northern England, the company estimates each parking space could generate about 1,100 kilowatt hours of electricity annually. The canopies are linked to the electric grid so energy “can be generated for use in the associated buildings when cars are not being charged,” Webster said. “No electricity is wasted.”

It’s got a distinctive shape that advertises itself and just might end up the most attractive piece of engineering in a Walmart parking lot. It could even help to drive sales, as customers might linger a little longer in the store waiting for their Tesla to charge.
